Affectionate Nickname Banned In Barry Island?

Barry Island, Wales, is probably best known for being the home of the female lead in TV's Gavin and Stacey. It's also a resort town with many attractions, including a colourful ferris wheel that the locals like to call the Barry Eye. I mean, it's not as if it could possibly be confused with the London attraction of the same name, right?

On the website for the Barry Island Pleasure Park the ride is referred to as 'Giant Ferris Wheel', so there's no effort being made to ride on the coattails of the London Eye. It looks different, too.

This is a case of the locals deciding to refer to their town's attraction by a nickname they've chosen. How in the world do Merlin Entertainments Group propose to enforce their trademark rights when the Danter family, who own the giant ferris wheel, aren't actually calling their wheel by the name "Eye" at all?
